I don’t think so. It would technically just be setting new precedent I think (which opens up a whole different can of worms). But it wouldn’t have rendered the appointment invalid on a retroactive basis.

I kinda get saying that about the admin, but Thune’s office is typically very well run. This must be quite embarrassing for them.
Basically this new en bloc procedure was made to confirm nominees in a batch processing system with a simple majority. But Sara Bailey’s nomination for director of national drug control policy requires 60 votes. Dems let republicans burn the whole week and waited till the last minute to point this out, thereby scuttling the whole batch.
In fairness to Thune’s team, this is a brand new process and they probably don’t have the review process nailed down yet.
Say what you will about it being a new process. Doesn’t change the fact that the Dems were able to figure it out but the team creating the process couldn’t. I’d be mortified if I was the one in charge.
What did the RPC product say about this? Don’t they usually include the vote threshold in the first paragraph? Seems like someone there also fucked up.
